Terms of Service

These Terms of Service ("Terms") govern your use of Whistle and the cinematechs.ca website, provided by Cinematechs AI Inc. ("Cinematechs", "we"). By using the service or joining the beta you agree to these Terms.
1. Acceptance
If you use Whistle on behalf of a business, you confirm you are authorized to bind that business to these Terms.
2. Beta service
Whistle is offered as a private beta. It is provided "as is", may change, and may have limits or interruptions. Features described on our site are in active development and may be added, changed, or removed.
3. Accounts
You are responsible for your account and for keeping your credentials secure. You must provide accurate information and be at least the minimum age in our Privacy Policy.
4. Acceptable use
- Don't use Whistle to break the law or to violate any connected platform's terms (including Meta, Google, and TikTok platform policies).
- Don't publish spam, deceptive, infringing, or harmful content.
- Don't attempt to reverse-engineer, resell, or abuse the service or its rate limits.
5. Connected platforms
Whistle integrates with third-party platforms (e.g. Instagram, Facebook, Google, TikTok) using the permissions you grant. Your use of those platforms remains subject to their own terms. We access and act on platform data only as described in the Privacy Policy, and we comply with each platform's developer/platform terms.
6. Your content
You keep ownership of the content and data you provide. You grant us a limited licence to process it solely to operate the service for you (e.g. to draft, schedule, and — on your approval — publish it).
7. AI-generated output
Whistle uses AI to generate drafts and suggestions. AI output can be inaccurate or unsuitable — you are responsible for reviewing it before it is published or acted upon. We make no guarantee that output is fit for a particular purpose.
8. You are always in control
Whistle does not publish, post, or spend on your behalf without your explicit approval. Any action taken on a connected platform reflects an approval you gave in the product.
9. Fees
The beta may be free or discounted. If paid plans apply, fees, billing cycles, and taxes will be shown before you subscribe, processed by Stripe. Amounts are in CAD unless stated otherwise.
10. Our intellectual property
The Whistle software, brand, and the methods behind our audits and scoring are owned by Cinematechs and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; they do not transfer our IP to you.
11. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that results (e.g. growth, reach, or revenue) will be achieved.
12. Limitation of liability
To the fullest extent permitted by law, Cinematechs is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or CAD $100.
13. Termination
You may stop using Whistle and delete your account at any time. We may suspend or end access for breach of these Terms or to protect the service. On termination we handle your data as described in the Data Deletion policy.
14. Governing law
These Terms are governed by the laws of Ontario, Canada, and you agree to the exclusive jurisdiction of its courts, without regard to conflict-of-laws rules.
